1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of TitleSight (the “Platform”), which is owned and operated by Vonly LLC (“Vonly,” “we,” “us,” or “our”). By using TitleSight, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.
These Terms apply to all users of the Platform, including visitors, registered users, and any others who access or use TitleSight.
2. Use of Services
To ensure the Platform operates smoothly and legally, you must adhere to the following conditions:
Eligibility: You must be at least 13 years of age to use TitleSight. If you are under the age of 13, you are not permitted to access or use the Platform.
Account Creation: Some features may require you to create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account.
Prohibited Activities: You agree not to misuse the Platform, including but not limited to:
Using the Platform for unlawful purposes or promoting illegal activities.
Attempting to gain unauthorized access to our systems or other users’ accounts.
Uploading harmful content such as viruses or malicious software.
Harassing, threatening, or defaming other users.
Redistributing or reselling data, reports, or analytics derived from TitleSight without our prior written consent.
Scraping, extracting, or downloading data from TitleSight outside of the provided functionality or APIs.
3. Customer Data and Content
Data Collected by Vonly: TitleSight processes and provides access to datasets collected and maintained by Vonly. We make commercially reasonable efforts to ensure accuracy, but do not guarantee that the data is error-free, complete, or up-to-date. You acknowledge that business decisions made using TitleSight are your responsibility.
Customer-Provided Data: You may provide additional data, such as lists, identifiers, uploads, or other content, for use within the Platform. You retain ownership of any such data. By submitting it, you grant Vonly a non-exclusive, royalty-free license to use, process, and display that data solely for the purpose of providing the Services to you.
User Content (e.g., comments, annotations, saved lists): You remain solely responsible for any content you create or share on the Platform. Vonly reserves the right to remove or restrict content that violates these Terms or applicable law.
Data Security: We use commercially reasonable safeguards to protect customer data. However, you acknowledge that no system is completely secure and we cannot guarantee absolute security of your data.
4. Intellectual Property
Ownership: TitleSight, its software, trademarks, logos, and designs are owned by Vonly LLC or its licensors and are protected by intellectual property laws.
Restrictions: You may not copy, modify, distribute, or create derivative works of any part of the Platform without our prior written permission. You may not reverse engineer, decompile, or disassemble the software used in TitleSight.
5. Termination
We reserve the right to suspend or terminate your access to the Platform at any time, including if you violate these Terms or engage in prohibited activities. Upon termination, all rights and licenses granted to you under these Terms will cease immediately.
6. Disclaimers
No Warranty: TitleSight is provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, secure, or error-free. Your use of the Platform is at your own risk.
Data Accuracy: TitleSight’s analytics are based on data collected from third-party sources as well as customer-provided inputs. While we strive for accuracy and reliability, we make no warranties regarding the completeness, correctness, or fitness for a particular purpose of such data.
7. Limitation of Liability
To the fullest extent permitted by law, Vonly LLC and its affiliates, directors, employees, or partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform or these Terms.
8. Changes to Terms
We may update or modify these Terms at any time. Any changes will be posted on this page, and the “Last Updated” date will be revised. Your continued use of the Platform after any modifications constitutes acceptance of the updated Terms.
9. Governing Law
These Terms and your use of TitleSight shall be governed by and construed in accordance with the laws of the United States of America and the State of California, without regard to its conflict of law provisions.
